Pro Football Hall of Famer Emmitt Smith Accused in $2.5 Million Solar Farm Investment Lawsuit

Emmitt Smith, the iconic Pro Football Hall of Fame running back, is facing accusations of defrauding a Native American investor of $2.5 million, according to a lawsuit filed in Delaware on Monday.

The legal complaint states that Kituwah LLC, the investment and economic development arm of the Eastern Band of Cherokee Indians, provided a $2.5 million loan after being persuaded to participate in a purported solar energy venture. The lawsuit names Smith, his business partner David Mosley, and their real estate company, 413 Solutions, Inc., as defendants in the allegations.

Allegations of Financial Misconduct

Kituwah LLC asserts that it has not received any repayment from the loan, which is now more than two years overdue. The firm further alleges that the funds it provided were instead used to reimburse a separate entity that had previously invested in the same project.

The investment was made into a venture known as Project Exodus solar farm. Kituwah claims it entered the agreement with the understanding that it would be designated a partner in the project, which was also expected to receive funding from the U.S. Department of Energy.

In its filing, Kituwah LLC is seeking a minimum of $2.5 million in damages, along with interest, legal costs, expenses, and any additional compensation determined during a trial.

"Kituwah poured substantial time, efforts, and resources in the purported joint venture," the lawsuit states. "Not only has Kituwah not seen any returns on its investment, Kituwah has been forced to expend additional costs in efforts to reclaim the amounts it is still owed pursuant to its investment, including to investigate what happened to its money."

Investor's Claims of Deception

The investment firm went as far as to characterize the alleged scheme as being "essentially, like a Ponzi scheme." Kituwah claims it was presented with "false projections and data" when it agreed to provide the loan, which it understood would be repaid "in a matter of months."

Following an internal investigation, Kituwah stated it discovered that the $2.5 million loan was directed to Wilson Holdings. Smith and the other defendants in the lawsuit reportedly have existing partnerships with Wilson Holdings on other separate investment endeavors.

Before his business ventures, Emmitt Smith established himself as a legendary figure in professional football. He holds the NFL record as the all-time leading rusher, accumulating an impressive 18,355 rushing yards over his Hall of Fame career. The majority of his career, spanning 13 seasons, was spent with the Dallas Cowboys, where he secured three Super Bowl championships. Smith concluded his playing career with two seasons as a member of the Arizona Cardinals.

Beyond his yardage record, Smith also holds the league's all-time records for rushing touchdowns, with 164, and rushing first downs, totaling 1,028.
